Fairholme Funds won an intermediate but potentially important victory in its lawsuit against the US government over Fannie Mae and Freddie Mac. Judge Sweeney has ruled that Fairholme will be able to file protected materials found during discovery in the Court of Federal Claims (which Sweeney is overseeing) in the related DC Circuit case currently on appeal. Fairholme only filed the motion on Monday but “the court finds no need to await a response from defendant to plaintiffs’ motion. Plaintiffs’ motion is granted,” Sweeney wrote.
